‘The Daily Show’: Jordan Klepper Isn’t Surprised Trump Defended Ignoring Judge’s Order With ‘Oral Doesn’t Count’ | Video

The Trump administration defended ignoring an order from a federal judge this week by saying the verbal order came too late after the written one and thus “didn’t count” — and “The Daily Show” host Jordan Klepper isn’t surprised.

This particular order came as President Donald Trump used an obscure law known as the Alien Enemies Act of 1798 to deport several people he suspected of being Venezuelan gang members. Said law is meant to be used during wartime, and allows the government to deport people without due process. It was last used to target Japanese Americans during World War II.

“Why does Trump always have to pick the oldest, most racist laws to do what he wants to do?” Klepper wondered before imitating Trump. “‘I’m cutting taxes under the authority of the ‘It’s OK to Drown Italians Law of 1863.'”

But, in an emergency hearing over the weekend, a federal judge ordered that the planes these people were sent away on be turned around.

The Trump administration opted to ignore that though, claiming the planes were already in the air over international waters when the written order came, putting them out of Trump’s jurisdiction. So, apparently, the verbal order, which came less than an hour earlier, didn’t count.

“It didn’t count! Yeah! Is that how rulings work? You have to put it in writing, you can’t just say it?” Klepper mocked. “Well, this is definitely not the first time that Trump has defended himself by arguing that oral doesn’t count.”

The comedian ultimately wasn’t surprised by the move and was actually pleasantly surprised at how long it took for something like this to happen.

“My God. I mean, if you had told me that Donald Trump would trigger a constitutional crisis just seven weeks into his term, I would have said that is a lot later than I thought,” he joked. “I mean, Donald showed a lot of restraint! I mean, Trump’s really becoming presidential.”
