Blake Lively Granted Confidentiality Order to Protect ‘Highly Personal and Intimate Information’ in Justin Baldoni Court Battle

Blake Lively was granted a confidentiality order on Thursday that will protect “highly personal and intimate information” from leaking during her ongoing court battle with “It Ends With Us” director and co-star Justin Baldoni.

The request, filed by the actress’ legal team and approved by Judge Lewis Liman on Thursday, will limit the disclosure of discovery material from her litigation against Baldoni, keeping some information to “attorneys eyes only.”

According to Judge Liman’s filing, such information includes:

  • Trade secrets; confidential business plans, marketing plans and strategies for clients other than the parties in this litigation; confidential business projects or leads on projects for clients other than the parties in this litigation; confidential creative projects or ideas other than those involved in this litigation
  • Security measures taken by parties or third parties
  • Medical information of parties or third parties
  • Highly personal and intimate information about third parties, and highly personal and intimate information about parties other than information directly relevant to the truth or falsity of any allegation in the complaints in this case

The protections also over any information copied or extracted, including excerpts, summaries or compilations thereof. Per the judge, both parties have agreed to enter a standard protective order that allows any person “producing discovery material to designate as confidential financial, business and personal or intimate information,” noting that the risk of disclosure is great and ultimately would cause harm to the producing party.

While both parties agreed on keeping sensitive information under wraps, Baldoni’s attorneys weren’t in favor of attorneys being blocked from sharing it with their clients, arguing that it would only create difficulties in their litigation process and ultimately parties will end up tussling before a judge over the terms of one another’s confidentiality agreements. In addition, the judge stated Lively’s request to limit any material that’s “likely” to cause some injury was too “broad” and thus wasn’t granted. However, he amended the provision to subject matter that’s “highly likely to cause a significant competitive, business, commercial, financial or privacy injury.”

A spokesperson for Lively shared their satisfaction with the judge’s decision.

“Today, the Court rejected the Wayfarer Parties’ objections and entered the protections needed to ensure the free flow of discovery material without any risk of witness intimidation or harm to any individual’s security,” the spokesperson said in a statement obtained by TheWrap. “With this order in place, Ms. Lively will move forward in the discovery process to obtain even more of the evidence that will prove her claims in Court.”

Lively is currently suing Baldoni, who directed and starred opposite her as a physically abusive husband in “It Ends With Us,” for sexual harassment and retaliation, while Lively and Reynolds are being countersued by Baldoni for defamation.
